robbery and attempted murder. san jose police have been looking for the suspect since last week after police say he and 26-year-old jonathan wilbanks and started a shoot-out with police that injured an officer. the teen's alleged accomplice wilbanks was arrested on november 16th, the night of the incident. today a memorial was held for rory parkpettiford. the 22-year-old was shot during the pair's attempted carjacking in a 7-eleven store in the 400 block of kieley boulevard. his brother says he is grateful the second suspect is behind bars. he also says he is overwhelmed with the outpouring of support from the community as the family comes to term with their loss. >> the plane flight back from hawaii to come bury my little brother was probably the longest five hours of my life, just sitting on the plane, just bawling my eyes out. and everyone is looking at me like who is this kid. it was absolutely terrible. i had to figure out what i was going to write on the plane, what i was going to say. it was really rough. but all the support is amazing. >> police say they're continuing to

42 people were arrested overnight after a confrontation with officers in san jose. it happened at a house on pa tt avenue before 11:00 last night. there was a large party going on at the home and when officers arrived, everyone scattered. many ran inside, locking the doors and closing the windows. moments later, bottles were being thrown from the back yard of the house. about 60 officers were called in to help along with the sheriff's department after a short standoff. police arrested 33 adults and nine juveniles from inside the house. two officers were injured in the chaos. new this morning, a frantic rush as crews spent three long hours trying to free a man stuck in a storm drain. around 9:00, the fire department got a report of a man stuck in a drain near the best buy store on fitzgerald drive. they found the 27-year-old man wedged in a 12 inch metal pipe, about three feet below the street's surface. they used a saw to cut the steel piping and managed to get the man out safely just after midnight. >> crews excavated around 12 or 13 feet that went to 7 feet below grade down t

and the update on the investigation there to the case. >> reporter: yeah. i checked in with the san jose police department spokesperson for the update on this case. they are still search for a second suspect or at least that's what was happening all this week as they released a sketch on that expect now hee mailed me back and said per the homicide unit we aren't confirming or denying any new information. that came after i asked them if an arrest had been made. >> the man was shot and killed last week. one of the suspects a 26-year- old was in court wednesday. police say he and another man robbed four businesses, murdered a 22-year-old in a carjacking and participated in a shoot out with two officers one of the officers was hit and taken to the hospital with minor injuries. willbanks was arrested the next morning. officers released a sketch of the second suspect, a 20,000- dollar reward is being offered for his arrest. the funeral for the victim is being held this morning at 11. we will continue to talk to police and ask them about updates on that second suspect and bring you new information on

on a deadly crime spree in san jose. the 15-year-old suspect linked to a series of violent crimes is expected to be arraigned this week. authorities finally caught the san jose resident on friday after he spent a week on the run. the suspect is linked to the november 16th killing of a man during a car jacking in the 7-eleven parking lot and attempted i can killing of a san jose police officer. the suspect's name is not being released because of his age. that could change if he is tried as an adult. the first suspect, 26-year-old johnathon dawson willbanks faces multiple charges with special circumstances. wilbanks is held without bail and due back in court on december 5th. >>> a san jose man wanted for murder is taken in to custody after he was spotted shopping at wal-mart on black friday. it happened at the wal-mart in morgan hill yesterday where an off-duty probation officer was also shopping. he recognized 18-year-old jay sob standing in the check out line. he had outstanding warrants at if ar murder and attempted murder. morganhill police responded and covered the store exits and made the

there feeling sick. >> reporter: monday night's are usually very busy at the club one here in the south san jose. but you can see there are very few cars or people here after an evacuation of woman's locker room. firefighters didn't take any chances inside using self- contained breathing apparatuses. personal trainer told me what happened right before they evacuated about 150 people from the building. >> one of my other clients came up to me and said, hey marlon there's something really strong in the bathroom. really strong and burning sensation, her eyes were burning and her -- she was coughing right after. >> reporter: a firefighter told me about 45 minutes ago that the odor was caused by eucalyptus room. the symptoms dissipate about an hour and a half. all of the victims went home and not to the hospital. i just we -- i just went back in and talked to club staff and they told me they will close at their regular hour at 11:00 and open at 5:00 in the morning. they also told me that the locker room is back open. >>> a sink hole opened up this afternoon swallowing the back wheels of a truck. th
